Vince Violins — Terms of Service

Welcome to Vince Violins (“Vince Violins,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, store, rentals, lessons, repair services, and related offerings (collectively, the “Services”). By using our Services, you agree to these Terms.
1) Acceptance & Updates
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time; the updated version will be posted with a new Effective Date. Your continued use constitutes acceptance.
2) Eligibility & Accounts
You must be at least 18 years old (or have parental/guardian consent) to enter into rental, purchase, or service agreements. If you create an account, you are responsible for maintaining its confidentiality and for all activity under it.
3) Lessons, Demonstrations & Appointments
Scheduling: All lessons, teacher demonstrations, and trial appointments must be booked in advance (online or by phone). Confirmation is required.
Cancellations/Rescheduling: Please cancel or reschedule at least 1 hour in advance.
Day-of Expectations: Please arrive 5–10 minutes early. Minors must be accompanied by a parent or guardian. Bring ID for rental trials. Instrument trials are typically limited to 45 minutes.
4) Rentals & Purchases
Rental Terms: All rentals are governed by your individual rental contract, including fees, deposits, maintenance, exchanges, and return policies.
Rental Credit: Rental payments may be applied toward eligible purchases as specified in your contract.
Care & Liability: You are responsible for the proper care of rented instruments and accessories. Damage, loss, or theft may result in additional charges unless covered by an optional protection plan stated in your contract. Please refer to our finalized Return & Exchange Policy for applicable terms.
Sales & Trade-In: Instruments purchased through Vince Violins may be eligible for trade-in under our current program. Bows and accessories are final sale unless otherwise stated in writing. See our Return & Exchange Policy on the Returns page for full details.
5) Repairs, Setup & Maintenance
We provide professional setups and repair services. Estimates are provided upon inspection. Approved repair work is billable at quoted rates; additional work requires your consent unless necessary for safety or to prevent further damage. Normal wear (e.g., strings, bow rehair) is the customer’s responsibility unless otherwise specified in writing.
6) Pricing, Taxes & Promotions
All prices are in U.S. dollars and are subject to change without notice. Applicable taxes and fees (including protection plans or shipping) are additional. Promotions or discounts cannot be combined unless explicitly stated and may be limited by instrument category or availability.
7) Pickup & Shipping
In-Store Pickup & Drop-Off (default): We currently offer in-store pickup and drop-off only. Please bring a valid ID and your order confirmation (and any other documents we request).
8) Returns & Exchanges
Returns, exchanges, and restocking (if any) are governed by our Return & Exchange Policy posted on our website and referenced in your contract. Certain items (including bows and accessories) are final sale unless stated otherwise in writing.
9) Intellectual Property
All content on our website and in our materials—including text, imagery, logos, product descriptions, and designs—is owned by Vince Violins or used under license. You may not copy, modify, distribute, or use our content without prior written consent.
10) Acceptable Use
You agree not to misuse our website, appointment systems, or communications tools, including attempting to access data without authorization, introducing malware, scraping content, or interfering with site performance.
11) Warranties & Disclaimers
Except as expressly stated in writing, our Services and products are provided “as is” and “as available.” While we professionally set up and inspect instruments, tone and performance results vary by player and environment. We disclaim all implied warranties to the fullest extent permitted by law.
12) Limitation of Liability
To the maximum extent permitted by law, Vince Violins is not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services or products. Our total liability for any claim will not exceed the amount you paid to us for the specific product or service giving rise to the claim.
13) Indemnification
You agree to indemnify and hold harmless Vince Violins and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.
14) Third-Party Services
We may use third-party providers (e.g., payment processors, shipping carriers, scheduling or POS platforms). Your use of those services may be subject to their terms and privacy policies.
15) Privacy
Our collection and use of personal information is described in our Privacy Policy. By using our Services, you consent to those practices.
16) Governing Law & Venue
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Maryland.
17) Severability & Waiver
If any provision of these Terms is deemed unenforceable, the remaining provisions will continue in full force. Our failure to enforce a provision is not a waiver of our right to do so later.
